1. What PropertyFlags is
PropertyFlags ("we", "us") sells a speed and convenience service: for a one-off fee we pull together publicly available government data about a NSW address — zoning, planning controls, mapped hazards, nearby development applications, school catchments, neighbourhood statistics and sun geometry — into one readable report in about a minute, together with a plain-English summary generated with the help of AI.
All of the underlying data is free and public. You are paying us to gather and present it quickly — not for the data itself, and not for advice.
2. What PropertyFlags is not
- It is not professional advice — not legal, financial, valuation, building, pest, planning or conveyancing advice, and not a substitute for a building & pest inspection, strata report, or your own conveyancer's searches.
- It is not a guarantee that a property is free of any risk. A report is a starting point for your own checks, done at the speed of a buying decision.
- It is not exhaustive: it reflects only the government datasets we query, as they stood at the moment the report was generated.
3. Data accuracy — read this before relying on anything
Report content comes live from third-party government services. Those services provide their data without warranty as to accuracy, completeness or currency, and so do we. Records can be out of date, incomplete, or wrong; council-level information (for example development applications) may not cover every council.
Some figures are clearly labelled estimates — including flight-noise outside mapped ANEF contours, apartment level estimates, and winter-sun/overshadowing calculations. Estimates are geometric approximations, not measurements, and must not be treated as facts.
Where a data source did not respond, the report says so instead of showing a falsely reassuring "clear". If a section says data was unavailable, check that item directly with the relevant authority.
4. Your Australian Consumer Law rights
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Our services come with guarantees that cannot be excluded, including that they will be provided with due care and skill and be fit for the purpose we describe here.
To the extent permitted by law, our liability for a failure of the service is limited to re-supplying the report or refunding what you paid for it, and we are not liable for indirect or consequential loss (including loss connected to a property purchase decision) arising from reliance on report content — because the service you bought is fast aggregation of public data, not advice (see sections 1–3).
5. Payment, delivery and refunds
- Payment is a one-off charge in Australian dollars, processed by Stripe. We never see your card details.
- Your report link is shown immediately after payment and stays valid; we also email it to the address you gave at checkout (keep that email).
- If your payment succeeds but a report cannot be generated for the address at all, we will refund you in full — contact us with your Stripe receipt.
- Core-sections guarantee: if three or more core sections of your report (zoning, flood, bushfire, heritage, development applications, contamination, land reservation) remain unavailable even after refreshing, we will refund you in full on request — reply to your report email or contact us with your Stripe receipt.
- If some data sources were temporarily down when you first opened the report, the link keeps working — refresh later and those sections fill in.
6. Fair use
A report is for your (or your client's) own use in relation to the address it covers. Don't bulk-purchase reports to republish, resell, or build a competing dataset — government licence conditions flow through to how report content can be reused, and the attribution notices in the report footer must stay intact.
7. Privacy
We collect the minimum needed to deliver the service: the address you query, and the email you give Stripe at checkout (used to send your report link and receipt). We don't sell personal information and we don't add you to marketing lists without asking. Payment data is handled by Stripe under their terms.
8. The boring but necessary bits
- These terms are governed by the laws of New South Wales, Australia.
- We may update these terms; the "last updated" date above changes when we do. Material changes won't apply retroactively to reports already purchased.
- The PropertyFlags website and reports are operated and provided by Piril Kugu Iscan Gurcaglar (sole trader), ABN 23 142 520 951, NSW, Australia. Prices are shown in AUD. No GST is charged — the provider is not registered for GST, and receipts are not tax invoices. Contact: [CONTACT EMAIL].
